1. Introduction

Welcome to Sinbad (”Sinbad,” “we,” “our,” or “us”).

This Return, Refund & Cancellation Policy explains the rights, responsibilities, and procedures applicable to the cancellation of orders, the return of eligible products, and the issuance of refunds for purchases made through the Platform.

Sinbad operates as a multi-vendor marketplace that connects Customers with independent Sellers. While Sinbad provides the Platform, payment processing, customer support, and operational services, individual Sellers remain responsible for the products they offer and for complying with applicable legal obligations relating to those products.

This Policy is intended to provide a fair, transparent, and consistent process for Customers, Sellers, and Sinbad while protecting the legitimate interests of all parties.

This Policy forms an integral part of the Terms of Service and should be read together with the Privacy Policy and any additional policies published by Sinbad.

Nothing contained in this Policy limits any mandatory rights granted to Customers under applicable law.


2. Scope

This Policy applies to all purchases completed through the Sinbad Platform, including purchases made through:

  • The official Sinbad website;
  • Official Sinbad mobile applications;
  • Marketplace orders;
  • Multi-vendor orders;
  • Single-vendor orders;
  • Promotional campaigns;
  • Orders using online payment methods;
  • Orders using Cash on Delivery (where available).

Certain products, services, or promotional campaigns may be subject to additional return or refund conditions where expressly stated before purchase.

Where such conditions conflict with this Policy, the specific conditions applicable to that product or service shall prevail only for that product or service.


3. Definitions

For the purposes of this Policy:

Cancellation means the termination of an order before its successful completion.

Return means the approved process by which eligible products are sent back after delivery.

Refund means the repayment of eligible amounts to the Customer following an approved cancellation, return, failed order, or other qualifying event.

Customer means the purchaser placing an order through the Platform.

Seller means the merchant supplying products or services through the Platform.

Order means any purchase submitted through Sinbad.

Marketplace Order means an order containing products from one or more independent Sellers.

Multi-Vendor Order means an order containing products from multiple Sellers within a single checkout.

Applicable Law means all applicable consumer protection laws, electronic commerce laws, financial regulations, and other mandatory legal requirements governing the transaction.


4. General Principles

Sinbad seeks to resolve cancellation, return, and refund requests fairly, consistently, and in accordance with this Policy, applicable law, and the operational requirements of the Platform.

Each request is assessed individually based on the facts of the transaction, available evidence, the condition of the products, Seller obligations, Customer actions, delivery records, and applicable legal requirements.

Approval of one request does not establish a precedent requiring approval of future requests under different circumstances.

Sinbad reserves the right to request additional information, photographs, videos, invoices, delivery confirmations, or other supporting evidence where reasonably necessary to evaluate a request.

Fraudulent, abusive, misleading, or repetitive misuse of the return or refund process may result in suspension or restriction of Platform privileges in accordance with the Terms of Service.


5. Responsibilities

5.1 Customer Responsibilities

Customers are expected to:

  • Review product information before purchasing.
  • Provide accurate delivery information.
  • Inspect delivered products within a reasonable time after delivery.
  • Report issues promptly through the Platform.
  • Cooperate with reasonable verification requests.
  • Return approved products in substantially the same condition in which they were received, together with original accessories, manuals, packaging, and included items where applicable.

5.2 Seller Responsibilities

Sellers are responsible for:

  • Supplying products that accurately match their published descriptions.
  • Delivering products in saleable condition.
  • Packaging products appropriately.
  • Cooperating with legitimate return and refund investigations.
  • Complying with applicable consumer protection obligations.
  • Responding to Platform requests within the required operational timeframes.

5.3 Sinbad Responsibilities

Sinbad is responsible for operating the Platform, facilitating communications, coordinating operational workflows, processing eligible refunds where applicable, managing disputes in accordance with Platform policies, and maintaining fair marketplace operations.

Unless otherwise required by applicable law or expressly stated in this Policy, Sinbad is not the manufacturer of products sold by independent Sellers and does not independently guarantee every product offered through the Platform.


6. General Eligibility

Not every cancelled order qualifies for a refund, and not every delivered product qualifies for return.

Eligibility depends upon multiple factors, including but not limited to:

  • Order status;
  • Payment method;
  • Product category;
  • Product condition;
  • Time elapsed since delivery;
  • Applicable law;
  • Seller obligations;
  • Evidence provided;
  • Operational circumstances;
  • Safety or hygiene considerations.

Requests submitted after unreasonable delay may be declined where permitted by applicable law.


7. Order Cancellation Policy

Cancellation requests are handled based on the status of the order at the time the request is received.

Because order processing may begin immediately after an order is placed, the availability of cancellation may vary depending on the operational stage of the order.

Submission of a cancellation request does not automatically guarantee approval.

Each request will be evaluated in accordance with this Policy, the operational status of the order, and applicable law.


7.1 Customer Cancellation Before Order Confirmation

Customers may request cancellation of an order before the order has been confirmed for processing.

Where cancellation is successfully completed before order confirmation:

  • The order will be cancelled.
  • No further order processing will occur.
  • Eligible payments may be refunded in accordance with this Policy.
  • The Customer will not be charged for products that are not fulfilled, except where applicable law or disclosed payment conditions provide otherwise.

7.2 Cancellation After Order Confirmation

Once an order has been accepted for processing, cancellation may no longer be possible.

Factors considered include:

  • Seller acceptance;
  • Inventory reservation;
  • Packaging;
  • Operational preparation;
  • Marketplace processing;
  • Payment processing;
  • Applicable legal requirements.

Where cancellation is no longer operationally possible, the Customer may instead be required to complete delivery and submit a return request if the product qualifies under this Policy.


7.3 Cancellation During Order Preparation

If the Seller has already started preparing the order, Sinbad may determine that cancellation is no longer reasonably possible.

Operational preparation may include:

  • Inventory allocation;
  • Picking;
  • Packaging;
  • Label generation;
  • Shipment preparation;
  • Handover scheduling.

Requests submitted during this stage will be reviewed individually.


7.4 Cancellation After Dispatch

Once an order has been dispatched for delivery, cancellation may not be possible.

Depending on operational circumstances, the order may instead:

  • Continue to delivery;
  • Be refused by the Customer where permitted;
  • Become eligible for return after delivery if applicable.

Additional operational costs may be considered where permitted by applicable law.


7.5 Cancellation of Marketplace Orders

Marketplace orders may contain products supplied by one or more independent Sellers.

Accordingly:

  • Some items may remain eligible for cancellation;
  • Other items may already be in processing;
  • Some Sellers may complete fulfillment while others have not yet started.

Cancellation eligibility is therefore determined separately for each affected item or Seller where operationally appropriate.


7.6 Cancellation of Multi-Vendor Orders

Where an order contains products supplied by multiple Sellers:

  • Cancellation of one Seller’s products does not automatically cancel the remaining Sellers’ products.
  • Each Seller’s portion of the order may be processed independently.
  • Refund calculations may therefore differ between Sellers within the same checkout.

7.7 Cancellation Initiated by the Seller

A Seller may cancel an order where reasonably necessary, including situations such as:

  • Product unavailable;
  • Inventory error;
  • Pricing error requiring cancellation under applicable law;
  • Operational impossibility;
  • Suspected fraud;
  • Safety concerns;
  • Legal restrictions.

Where a Seller cancels an order after payment has been received, eligible refunds will be processed in accordance with this Policy.

Repeated unjustified Seller cancellations may result in operational action by Sinbad.


7.8 Cancellation Initiated by Sinbad

Sinbad may cancel an order where reasonably necessary, including:

  • Suspected fraud;
  • Duplicate orders;
  • Payment authorization failure;
  • Platform malfunction;
  • Security concerns;
  • Legal compliance requirements;
  • Operational impossibility;
  • Force majeure events;
  • Other exceptional circumstances affecting Platform integrity.

Where applicable, eligible refunds will be processed according to this Policy.


7.9 Partial Cancellation

Where operationally possible, part of an order may be cancelled without cancelling the entire order.

Examples include:

  • One unavailable product;
  • One cancelled Seller;
  • Quantity adjustments;
  • Inventory shortages.

Partial cancellation does not automatically affect the remaining items in the order.

Refunds relating to partially cancelled items will be calculated independently.


7.10 Cancellation Abuse

Customers, Sellers, or other users must not misuse the cancellation process.

Examples of abuse include:

  • Repeated fraudulent cancellations;
  • Intentional abuse of payment systems;
  • Repeated refusal of deliveries without legitimate reason;
  • False operational claims;
  • Abuse intended to disrupt Sellers;
  • Circumvention of Platform policies.

Where abuse is identified, Sinbad may take appropriate action, including:

  • Account warnings;
  • Temporary restrictions;
  • Permanent suspension;
  • Investigation;
  • Recovery of losses where permitted by applicable law.

7.11 Effect of Cancellation

Once an order has been successfully cancelled:

  • The order status will be updated accordingly.
  • Eligible refunds, if any, will be processed in accordance with the Refund Policy section of this document.
  • Cancellation of an order does not automatically determine eligibility for compensation, damages, or additional payments unless required by applicable law.

8. Return Policy

The availability of product returns depends on the nature of the product, its condition, the reason for the return, the time elapsed since delivery, applicable law, and the operational requirements of the Platform.

Submission of a return request does not automatically guarantee approval.

Each request shall be reviewed individually based on the circumstances of the transaction and the supporting evidence provided.


8.1 General Return Eligibility

Unless otherwise prohibited by applicable law or this Policy, a product may be eligible for return where:

  • The return request is submitted within fourteen (14) days from the date of purchase or receipt, as applicable under the mandatory laws governing the transaction, unless a longer period is expressly offered by the Seller or Sinbad.
  • The product remains in substantially the same condition as received;
  • The product has not been damaged due to misuse;
  • All original accessories, manuals, warranty cards, seals, labels, and packaging (where applicable) are included;
  • The product qualifies for return under this Policy.

Certain products may require inspection before return approval.

For transactions governed by the laws of the State of Kuwait, Customers generally have the right to request the exchange or return of eligible products and recover the amount paid within fourteen (14) days, subject to the product remaining in its original condition and to the exclusions and special rules prescribed by applicable law.


8.2 Products That May Not Be Eligible for Return

Subject to applicable law, the following products may not be eligible for return, including but not limited to:

  • Products damaged through misuse or negligence;
  • Products intentionally modified by the Customer;
  • Products missing essential components;
  • Products returned without required accessories where applicable;
  • Personalized or custom-made products;
  • Products manufactured specifically upon Customer request;
  • Digital products or digital content after successful delivery or activation, unless otherwise required by law;
  • Gift cards, vouchers, or prepaid credits where prohibited by law;
  • Products expressly identified as non-returnable before purchase where permitted by applicable law.

8.3 Perishable Products

Due to health, safety, and quality considerations, perishable products may not be eligible for return after delivery unless:

  • The wrong product was delivered;
  • The product arrived damaged;
  • The product was spoiled upon delivery;
  • The product exceeded its usable shelf life at the time of delivery;
  • The return is otherwise required by applicable law.

Perishable products include, without limitation:

  • Fresh food;
  • Chilled products;
  • Frozen products;
  • Bakery products;
  • Fresh meat;
  • Poultry;
  • Seafood;
  • Fresh fruits;
  • Fresh vegetables;
  • Dairy products.

8.4 Hygiene and Personal Care Products

For health and safety reasons, opened or used hygiene products may not be eligible for return unless:

  • The wrong product was delivered;
  • The product was defective upon delivery;
  • The product arrived damaged;
  • Applicable law requires otherwise.

Examples include:

  • Cosmetics;
  • Personal care products;
  • Oral care products;
  • Personal hygiene products;
  • Similar sealed products.

8.5 Clothing and Fashion Products

Clothing, footwear, and fashion accessories may be eligible for return provided that:

  • They have not been worn beyond reasonable inspection;
  • Original tags remain attached where applicable;
  • They are clean;
  • They are free from alteration;
  • They remain in resalable condition.

8.6 Special Short Return Periods

Certain product categories may be subject to shorter statutory return or exchange periods under applicable law.

For transactions governed by the laws of the State of Kuwait, certain categories—including precious goods such as jewelry and watches, eyewear, evening and wedding clothing, perfumes, and certain products that come into direct contact with the skin—may be subject to a return or exchange period not exceeding twenty-four (24) hours, where the return or exchange option is stated on the purchase invoice and the product remains in its original condition.

The applicable mandatory legal requirements shall prevail in all cases.


8.7 Electronics

Electronic products may be eligible for return subject to:

  • Inspection;
  • Verification of reported defects;
  • Presence of original accessories;
  • Original packaging where reasonably available;
  • No evidence of accidental damage, misuse, unauthorized repair, or modification unless otherwise required by applicable law.

Manufacturer warranty rights remain governed by the applicable warranty terms.


8.8 Incorrect Product

Where the Customer receives a product different from the confirmed order, the Customer should report the issue as soon as reasonably possible.

Upon verification, Sinbad may arrange:

  • Product replacement;
  • Product return;
  • Refund;
  • Other appropriate resolution.

8.9 Damaged Products

If a product arrives damaged, Customers should report the issue promptly and provide supporting evidence where reasonably requested.

Supporting evidence may include:

  • Photographs;
  • Videos;
  • Delivery packaging;
  • Shipping labels;
  • Other relevant documentation.

Failure to provide requested evidence may affect the ability to evaluate the claim where permitted by applicable law.


8.10 Missing Items

If one or more items are missing from an order, Customers should report the issue promptly through the Platform.

Sinbad may investigate the order using available operational records, including fulfillment records, delivery confirmation, Seller records, and other relevant information.

Where the claim is verified, Sinbad may provide an appropriate resolution, including shipment of missing items, replacement, refund, or another reasonable remedy.


8.11 Return Inspection

Returned products may be inspected before a final decision is made.

Inspection may verify:

  • Product condition;
  • Product identity;
  • Serial numbers where applicable;
  • Signs of use;
  • Missing accessories;
  • Damage;
  • Tampering;
  • Packaging condition;
  • Compliance with return requirements.

Inspection results may affect return approval and refund eligibility.


8.12 Return Shipping

Unless otherwise required by applicable law or expressly stated by Sinbad, responsibility for return shipping may depend upon the reason for the return.

Where the return results from:

  • Seller error;
  • Incorrect shipment;
  • Defective products;
  • Damaged delivery;
  • Operational error attributable to Sinbad;

the cost of return shipping may be borne by the responsible party as determined by Sinbad.

Where the return is based solely upon Customer preference, the Customer may be responsible for applicable return shipping costs where permitted by applicable law.


8.13 Rejected Returns

A return request may be declined where:

  • The product is not eligible under this Policy;
  • Required evidence is not provided where reasonably requested;
  • The product has been materially altered;
  • The product has been intentionally damaged;
  • Fraud is suspected;
  • The request violates applicable Platform policies.

Where a return is rejected, Sinbad may return the product to the Customer or otherwise handle the product in accordance with applicable law and operational requirements.


8.14 Legally Restricted Products

Certain products may be subject to legal, regulatory, health, safety, environmental, or public policy restrictions that limit or prohibit their return, replacement, refund, transportation, or resale.

Such products may include, without limitation:

  • Prescription medicines;
  • Medical devices;
  • Hazardous materials;
  • Chemicals;
  • Batteries;
  • Gas cylinders;
  • Age-restricted products;
  • Controlled products;
  • Products requiring governmental authorization;
  • Any other products restricted by applicable law.

Where applicable law restricts or prohibits the return, replacement, or refund of such products, Sinbad shall comply with those legal requirements.

Nothing in this Policy shall be interpreted as granting return or refund rights that are prohibited by applicable law.


9. Refund Policy

Refund eligibility depends upon the reason for the refund request, the status of the order, the outcome of any investigation, the payment method used, applicable law, and the provisions of this Policy.

Approval of a cancellation or return request does not automatically guarantee entitlement to a refund.

Each refund request shall be evaluated individually.


9.1 General Refund Principles

Where a Customer is entitled to a refund, Sinbad will process the refund using an appropriate refund method determined by:

  • The original payment method;
  • Applicable law;
  • Operational capabilities;
  • Payment provider requirements;
  • The circumstances of the transaction.

Refunds shall only include amounts determined to be refundable under this Policy or applicable law.


9.2 Online Payment Refunds

Where an order was paid using an electronic payment method, approved refunds will be returned through the original payment method where required by applicable law. Where legally permitted and agreed with the Customer, another appropriate refund method may be used.

Processing times may vary depending on:

  • Payment provider;
  • Financial institution;
  • Banking procedures;
  • Applicable regulatory requirements.

Sinbad is not responsible for delays occurring after an approved refund has been successfully submitted to the payment provider.


9.3 Cash on Delivery Orders

Where a Cash on Delivery order qualifies for a refund after payment has been collected, Sinbad will determine the appropriate refund method based upon the operational procedures available at the time.

Additional verification may be required before processing refunds for Cash on Delivery transactions.


9.4 Partial Refunds

A refund may be issued for only part of an order where appropriate.

Examples include:

  • One returned product;
  • One cancelled Seller;
  • Missing items;
  • Quantity adjustments;
  • Pricing corrections;
  • Partially fulfilled orders.

Each refundable amount will be calculated independently.


9.5 Refund Calculation

Refund amounts may be calculated based upon one or more of the following factors, where applicable:

  • Product price actually paid;
  • Promotional discounts;
  • Coupons;
  • Vouchers;
  • Loyalty rewards;
  • Taxes;
  • Delivery charges;
  • Payment processing fees;
  • Returned quantities;
  • Partial order fulfillment;
  • Applicable legal requirements.

Refund calculations may therefore differ from the original order value depending upon the circumstances of the transaction.


9.6 Multi-Vendor Refunds

Where an order contains products supplied by multiple Sellers, refund eligibility shall be assessed separately for each Seller’s portion of the order.

Approval of one Seller’s refund does not automatically result in refunds for products supplied by other Sellers.


9.7 Delivery Fees

Delivery fees may or may not be refundable depending upon:

  • Whether delivery was successfully completed;
  • The reason for cancellation;
  • Operational responsibility;
  • Applicable law;
  • Other relevant circumstances.

Where delivery services were fully performed, delivery fees may not be refundable unless otherwise required by applicable law.


9.8 Payment Processing Fees

Payment processing fees charged by banks, payment gateways, financial institutions, or payment service providers may be allocated between Sinbad and the Seller in accordance with their commercial arrangements.

Such fees shall not be deducted from an amount that must be refunded to the Customer under mandatory applicable law.

Where no mandatory refund right applies, the treatment of payment processing fees may depend on the circumstances of the transaction, the payment terms disclosed at checkout, the ability to recover the fee from the payment provider, and applicable law.

Nothing in this section limits any mandatory rights granted to Customers.


9.9 Promotional Discounts

Where an order includes promotional discounts, coupons, vouchers, loyalty rewards, or other promotional benefits, any approved refund may be calculated based upon the actual amount paid by the Customer rather than the original listed product price.

Promotional benefits associated with cancelled or refunded purchases may be withdrawn, adjusted, or reversed where reasonably necessary.


9.10 Refund Verification

Before issuing a refund, Sinbad may verify:

  • Order records;
  • Payment records;
  • Delivery confirmation;
  • Return inspection results;
  • Seller response;
  • Customer evidence;
  • Fraud indicators;
  • Other relevant operational information.

Refund processing may be delayed where additional investigation is reasonably necessary.


9.11 Failed Payments

If an online payment fails before successful authorization or settlement, no refund process is generally required because payment has not been successfully completed.

Where payment status is uncertain, Sinbad may conduct reasonable verification before determining whether a refund is required.


9.12 Duplicate Payments

Where the same order is accidentally charged more than once and duplicate payment is verified, the duplicate amount may be refunded using an appropriate refund method.

Verification may include payment provider records, transaction references, banking information, and internal financial records.


9.13 Fraudulent Refund Requests

Sinbad reserves the right to reject refund requests where there is reasonable evidence of:

  • Fraud;
  • Payment abuse;
  • False claims;
  • Misrepresentation;
  • Manipulation of Platform systems;
  • Abuse of promotional campaigns;
  • Other conduct intended to obtain an improper financial benefit.

Where appropriate, Sinbad may suspend processing while an investigation is conducted.


9.14 Refund Completion

Once an approved refund has been successfully processed by Sinbad and transmitted to the applicable payment provider or refund channel, completion of the refund may remain subject to the processing times and procedures of banks, payment service providers, financial institutions, or other third parties.

Sinbad is not responsible for delays occurring after the refund has been successfully submitted outside its operational control.


9.15 No Double Recovery

Customers are not entitled to receive multiple remedies for the same issue.

Where a replacement product, store credit, refund, compensation, insurance settlement, manufacturer warranty, chargeback, or other remedy has already fully resolved the issue, additional recovery for the same loss may be declined to the extent permitted by applicable law.


9.16 Payment Chargebacks

Where a Customer initiates a payment chargeback, payment dispute, or similar financial recovery process through a bank, card issuer, payment service provider, or financial institution, Sinbad may suspend any duplicate refund processing while the external dispute remains pending.

Customers are encouraged to avoid initiating multiple recovery processes relating to the same transaction.

Sinbad reserves the right to provide transaction records, delivery evidence, communication records, and other relevant information to the applicable financial institution in order to respond to chargeback investigations where permitted by applicable law.

10. Disputes, Investigations and Final Provisions

Sinbad is committed to resolving disputes fairly, consistently, and in accordance with applicable law, this Policy, and the operational integrity of the Platform.

Where disagreements arise between Customers, Sellers, Delivery Providers, or other Platform participants, Sinbad may review the available information and determine an appropriate operational resolution.

Nothing in this Policy prevents any party from exercising rights available under applicable law.


10.1 Investigation Process

Where a cancellation, return, refund, complaint, or dispute requires further review, Sinbad may conduct an investigation before reaching a final decision.

An investigation may include review of:

  • Order records;
  • Payment records;
  • Delivery records;
  • Communication history;
  • Customer statements;
  • Seller responses;
  • Driver reports;
  • Product photographs;
  • Video recordings;
  • Live support records;
  • System logs;
  • Audit records;
  • Other relevant operational information.

Additional information may be requested from any affected party where reasonably necessary.


10.2 Evidence

To assist in resolving disputes, Sinbad may request supporting evidence.

Evidence may include:

  • Photographs;
  • Videos;
  • Delivery packaging;
  • Product serial numbers;
  • Purchase invoices;
  • Shipping labels;
  • Inspection reports;
  • Written statements;
  • Communication records;
  • Other relevant documentation.

Failure to provide reasonably requested evidence may affect the ability to evaluate a claim.


10.3 Seller Cooperation

Sellers are expected to cooperate with investigations conducted by Sinbad.

Failure to respond within reasonable operational timeframes may result in decisions being made based upon the information available at the time.

Repeated failure to cooperate may result in operational action, including:

  • Performance warnings;
  • Listing restrictions;
  • Temporary suspension;
  • Permanent removal from the Platform where appropriate.

10.4 Customer Cooperation

Customers are expected to provide truthful and accurate information.

Customers must not:

  • Submit false claims;
  • Manipulate evidence;
  • Alter returned products;
  • Abuse return procedures;
  • Misrepresent product conditions;
  • Attempt to obtain duplicate refunds or compensation.

Where fraudulent activity is reasonably suspected, Sinbad may suspend processing while an investigation is conducted.


10.5 Platform Decisions

Where this Policy grants Sinbad discretion, decisions will be made based upon:

  • Available evidence;
  • Operational records;
  • Applicable law;
  • Platform policies;
  • Fairness to all affected parties;
  • Protection of marketplace integrity.

Operational decisions are intended to resolve disputes efficiently while preserving the rights of Customers and Sellers.

Sinbad may facilitate communication and dispute resolution between Customers and Sellers in order to encourage fair and efficient outcomes.

Unless otherwise required by applicable law, Sinbad does not act as a court, arbitrator, judicial authority, or governmental dispute resolution body.


10.6 Fraud Prevention

Sinbad reserves the right to investigate activities that may indicate:

  • Payment fraud;
  • Identity fraud;
  • Return fraud;
  • Refund fraud;
  • Seller fraud;
  • Delivery fraud;
  • Promotional abuse;
  • Account abuse;
  • System manipulation;
  • Other unlawful or dishonest conduct.

Where appropriate, Sinbad may:

  • Suspend transactions;
  • Restrict accounts;
  • Delay refunds;
  • Cancel orders;
  • Preserve evidence;
  • Cooperate with competent authorities where legally required.

10.7 Force Majeure

Sinbad shall not be responsible for delays, interruptions, or failures resulting from events beyond its reasonable control, including but not limited to:

  • Natural disasters;
  • War;
  • Civil unrest;
  • Government actions;
  • Internet failures;
  • Power outages;
  • Telecommunications failures;
  • Payment network outages;
